Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Talvio (“Talvio,” “we,” “us,” or “our”), an AI-powered phone receptionist service, including our website at talvio.ai, our dashboard, and the receptionist services we provide (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

Talvio provides an AI-powered receptionist that answers phone calls on behalf of your business, handles inquiries, books and manages appointments, and sends appointment confirmation messages by SMS. Features and functionality may change over time as we improve the Service.

2. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the security of your account credentials, and for all activity that occurs under your account.

3. Your Responsibilities

You agree that you will:

• Use the Service only for lawful business purposes.
• Provide accurate business information for your receptionist and keep it current.
• Comply with all applicable laws and regulations, including those governing telephone calls, recordings, and SMS messaging.
• Obtain any consents required from your own customers and callers, including consent to receive SMS messages where applicable.
• Not use the Service to send unlawful, harassing, deceptive, or unsolicited messages.

4. SMS Messaging

The Service sends transactional SMS messages such as appointment booking, rescheduling, and cancellation confirmations. Message frequency varies based on appointment activity. Message and data rates may apply. Recipients may replySTOP to opt out or HELP for assistance. Carriers are not liable for any delayed or undelivered messages. You are responsible for ensuring that your customers have consented to receive messages in connection with your use of the Service. See our Privacy Policyand SMS Terms & Consent for details.

5. Billing and Subscriptions

Paid plans are billed in advance on a recurring basis through our payment processor. By subscribing, you authorize us to charge the applicable fees to your payment method until you cancel. Fees are non-refundable except where required by law. We may change our pricing with reasonable notice.

Each plan includes a set number of call minutes per billing cycle. Usage beyond your included minutes (“overage”) is charged at the per-minute rate shown for your plan. Overage is billed at the end of your billing cycle, or earlier if your accrued overage reaches $30 during a cycle, whichever occurs first. By subscribing, you authorize us to charge your payment method on file for overage amounts, including mid-cycle charges when the $30 threshold is reached.

6. Cancellation

You may cancel your subscription at any time through the dashboard or by contacting us. Cancellation takes effect at the end of your current billing period, and you will retain access to paid features until then.

7. Intellectual Property

The Service, including its software, design, and content, is owned by Talvio and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the business content and data you provide.

8. Third-Party Services

The Service relies on third-party providers for voice processing, AI, messaging, authentication, hosting, and payments. Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the AI receptionist will handle every call or request accurately. You are responsible for reviewing appointments and communications handled on your behalf.

10. Limitation of Liability

To the maximum extent permitted by law, Talvio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that may cause harm or legal liability. Upon termination, your right to use the Service ends, though certain provisions of these Terms will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
